Paragard FDA Letter
On July 25, 2019, the FDA issued a warning letter to CopperSurgical, Inc. the owners of the IUD Paragard. The letter accuses the manufacturer of airing misleading television ads that misrepresent the side effects of Paragard. According to the FDA, this constitutes a public health concern and the company was asked to stop airing the commercials and correct all promotional materials that gave a false impression about Paragard.
Complaints were filed against the company and after further investigation, the FDA determined that the complaints were well founded and violated the Federal Food, Drug and Cosmetic Act. While the product labeling clearly outlines all the potential side effects, these risks were minimized in commercial advertisements to the point where the ads were seen as misleading. The FDA found that the ads were quick to make claims about the benefits of Paragard, but failed to adequately explain the risks.

In the commercial, a voice over does list certain side effects. However, the list is incomplete and does not mention some of the most serious problems. This creates the impression that that product is much safer than it actually is.

The FDA also noted that the commercial uses bold and fast-paced visuals that detract from more important messages about the risks associated with the device. By using high energy music and quickly changing scenes, the commercial makes it difficult for viewers to make close attention to the information that is being shared. In addition, the ad only uses visuals to communicate risks when it should use both audio and visual tools for more accurate and understandable messaging.

When the ad does mention risks, the screen is showing unrelated images that don’t reinforce the information about risks. This is problematic, especially when some of the risks can be life threatening. It seems that Paragard was trying to position itself as a much safer alternative to hormone based IUDs, but the reality is that Paragard comes with serious risks that are comparable to other products.
After the FDA issued the letter to CooperSurgical Inc., the company was given two weeks to respond with a plan to take corrective action or to present a case for why the promotional materials were not in violation of certain FDA acts. This letter was just one of many problems that Paragard has run into in recent years. Misleading advertising and overly positive claims have also resulted in a large number of lawsuits from women who have experienced some of the worst side effects of this product.
